Warranty
This product is warranted for residential use only.
KIBA PERGOLA disclaims all other representations and warranties of any kind, express or implied.
This warranty excludes all consequential damages.
LIMITED WARRANTY
This warranty only covers COMFOLA products purchased on comfola.com.
To activate the COMFOLA limited warranty, the product registration must have been duly completed within 30 days after the date of arrival of the product by email info@comfola.com with a copy of the proof of purchase.
COMFOLA is not liable for any indirect, punitive, special, incidental, consequential or punitive damages or losses suffered by our products and/or the use of our systems.
COMFOLA warrants that this product is free from defects in materials and workmanship for a period* from the original date of purchase. This warranty period* covers all parts including aluminum, hardware, and accessories.
In addition, COMFOLA will replace any parts within the first 30 days from the date of purchase found to be missing from or damaged within the original packaging.
This warranty applies to the original owner and registrant and is non-transferable. Regular maintenance is required to assure maximum life and performance of this product and failure by the owner to maintain the product according to the maintenance requirements may void this warranty.
This warranty is applicable in the USA only.
*DURATION
The COMFOLA warranty is valid from the date of delivery of our products. The warranty is granted for a period of:
ALUMINUM PARTS / EXTRUSIONS - 10 YEARS
MOTORS - 1 YEARS
REMOTE CONTROL AND AUTOMATICS
- 1 YEARS
SCREENS / FABRICS - NONE
During this period, the warranty remains in effect as long as the user complies with the use and maintenance recommendations.
In accordance with relevant codes, all electric components are warranted subject to wire connections being protected and installed by a certified professional in waterproof boxes, protected from water and other conditions.
Application of the warranty or the purchase of a replacement part does not extend its duration.
WARRANTY EXCLUSIONS
The warranty does not cover :
• Damage to equipment resulting from storage, installation or maintenance not in accordance with this instruction manual.
• Damage due to use not in accordance with this instructions manual.
• Mechanical damage.
• Defects resulting from normal wear and tear of product parts, such as seals, lubricants, etc.
• Electrical damage caused by the user.
• Damage caused by incorrect installation of the product by a company other than an approved installation partner.
• Damage caused by installing the product on an unsuitable surface. The anchor bolts provided may not hold securely on certain surfaces
• Damage caused as a result of repairs carried out without permission.
• Damage caused during use of the system in inappropriate weather conditions (outside the expected range).
• Damage caused by abnormal weather conditions, such as lightning.
• Characteristic system noises during rotation of louvers.
• Leaks resulting from incomplete closure of movable components.
• Damage due to incorrect cleaning using inadequate tools, corrosive substances and abrasives.
• Atmospheric and phytosanitary pollution and contamination caused by animals.
• Damage caused by the influence of foreign products, objects or suspended accessories.
• The right to any claims in the event of self-repairs or the use of non-original spare parts.
• Differences in the color of the parts that may occur during the production process.
• Color changes of elements intensively exposed to harmful weather conditions.
• Corrosion of components used in environments with high sea salt content in the air.
• Possible cracks in the metalwork due to mechanical damages caused by incorrect pergola assembly or due to uneven heating due to the location of the pergola assembly.
• Leaks or leakages between gutter modules, or sealing of penetrations between the guttering that has been executed by the customer.
• A difference in the angle of the rotating louvers of under 5°, which is a natural feature of the system due to production and process tolerances of the components.
• Water formed by condensation, which can occur on the bottom surface of the louvers.
OTHER CONDITIONS AFFECTING THE WARRANTY
Application of the warranty shall be suspended without notice or delay if the Customer or Reseller has financial obligations in default to Pergolas and shall remain suspended until the Customer or Reseller has met these financial obligations to the satisfaction of Pergolas.
WARRANTY CLAIMS
Any claims under this warranty must be made in writing, and received at COMFOLA by email to the following address: support@comfola.com, within 30 days of discovery of the defect. This written notification must include the name and address of the Customer, a detailed description of the defect, photos to support the claim, the date of installation, the date the defect was discovered, the address where the product is installed, the name of the licensed electrician with the proof of licenses and the address of the reseller and a copy of the invoice.
The Company will have the right to inspect the structure and the product upon receipt of a warranty claim. Therefore, any repairs are to be avoided before the inspection by the Company. Any repairs or alterations to the product before the inspection may void said warranty at the sole discretion of the company.
After inspection, if the company determines that the warranty is applicable, the company, at its sole discretion and at its expense, will replace or repair the product, or refund any amount paid by the Customer for the purchase of the company product, all within 180 days of receipt of the warranty claim.
All labor charges generated by the company must be paid by the Customer after one year following the installation date.
In case of replacement of the product, if the same product is no longer available, it will be replaced by a product of equal value to the initial purchase value of the product being replaced.
WARNING
This written warranty is considered an official document and replaces all other previous warranties and conditions, written or verbal, mentioned or given to the Customer by the company. The company will not be held responsible, in any case, for the replacement cost of another product and/or for any direct or indirect operating loss.
This warranty shall be governed by the law of the USA.
